4C UR Future Terms of Use

The website and services available at www.4curfuture.com (the “site”), and any services provided by third parties via the site, are conditional upon you accepting the following Terms of Use, including our Privacy Notice and Cookies Policy (together, the “Terms & Conditions”). Your acceptance of the Terms & Conditions shall be indicated by your use of and/or registration with the site. The site is provided by 4C UR Future CIC, a Community Interest Company registered in Northern Ireland with company number NI659959.

Our Terms & Conditions form our entire agreement with you as a user of the site and supersede any prior agreement or arrangement in respect of the site.

1. Use of the Site
The site is designed for your personal, non-commercial use, and you must not use it in any other way without our consent. Except as permitted under applicable law, you must not use, copy, translate, publish, licence, distribute, or sell any materials or information on the site, or its structure, style, programme, or code, without our consent. You may use our site only for lawful purposes. You may not use our site in any way that:
a) Breaches any applicable local, national, or international law or regulation.
b) Is harmful, unlawful, or fraudulent, or has any unlawful or fraudulent purpose or effect.
c) Sends, knowingly receives, uploads, downloads, or uses in any way any material that does not comply with our content standards.
d) Knowingly transmits any data that contains viruses, Trojan horses, worms, time bombs, keystroke loggers, spyware, adware, or any other programmes or code designed to be harmful or to adversely affect the operation of any hardware or software.

In addition, you agree not to access without authority, interfere with, damage or disrupt:
a) Any part of our site.
b) Any equipment or network on which our site is stored.
c) Any software used in the provision of our site.
d) Any equipment, network, or software owned or used by any third party.

2. Availability of the Site
We endeavour to ensure the site is available 24 hours a day, 365 days per year, without any interruptions. We have robust systems in place to ensure the uptime and security of the site. However, we acknowledge that downtime may occur and have systems in place to reinstate the site as soon as possible. In addition, we reserve the right to make the site, or sections of the site, unavailable at any time, or to restrict access to parts or all of the site, in line with any operational requirements.

Any breach of the Terms & Conditions by you may, at our sole discretion, result in your access rights to the site being suspended or revoked.

3. Intellectual Property
Unless otherwise indicated, the content of the site, including but not limited to all text, imagery, and artwork, is protected by copyright. The copyright is owned by us or is otherwise licenced from a third party for use by us. The site contains registered and unregistered trademarks, which we either own or are licenced to use. All other rights that are not specifically granted are reserved. Where the names, logos, and trademarks of third parties are displayed, these are used with the permission of the owners. The authors of the content and documents that appear on the site assert their moral rights. www.4curfuture.com is a registered domain name owned by 4C UR Future CIC.

You may view or download any part of the site for private purposes/use, including but not limited to the purposes of seeking information, but you are not permitted without our permission to:
a) Store the site, or make copies of the site, for any other purpose;
b) Print copies of the site or its contents, for any other purpose;
c) Reproduce, copy, or transmit the site, or any part of the site, in any way, for any other purpose.

4. User Content and User Profiles
We may give you the option to send us content to be posted on the site, or social media, by us (“User Content”), or the ability to register for an online profile/account (“User Profile”).

By sending us User Content/creating a User Profile, you will be deemed to:
a) Warrant to us that all registration information you submit is truthful and accurate;
b) Consent to us editing User Content at our discretion;
c) Grant to us an irrevocable, worldwide, royalty free licence to use and publish User Content for any purpose associated with our objective to involve, inform, and inspire people to make more empowered career choices, being a catalyst for positive change in Northern Ireland’s skills performance by enabling people to fulfil their potential;
d) Irrevocably waive in our favour any moral rights you may have in such User Content in terms of the Copyright, Designs and Patents Act 1988, and any similar rights available in any part of the world; and
e) Warrant to us that you are the owner of the copyright and other intellectual property rights in the User Content, that the User Content is your original work, and that the User Content does not infringe the rights (including intellectual property rights) of any third party.

We do not guarantee that any User Content you submit will be posted on the site/social media.

Our site enables certain users to create a User Profile. This enables access to restricted areas of the site and enables us to provide you with a more personalised experience. We may also allow you to subscribe to certain pages of the site, to be notified of changes to that page, or subscribe to email newsletters and/or notifications via the site. We will hold the information you provide us on our databases. By creating a User Profile or subscribing to receive information from us, you are agreeing that we may use your personal information in this way. You will have the opportunity to view, update, or remove any personal information you provide to us by amending your User Profile. You also have the option to delete your User Profile.

Please note that comments made by other users of the site, or content provided by third parties that may be posted on the site, are provided for your information only and do not necessarily represent our views and opinions.

5. Content Standards
These content standards apply to any and all material that you may contribute to our site, and to any interactive services associated with it. You must comply with the letter, and the spirit, of the following standards. The standards apply to each part of any contribution as well as to it as a whole.

Contributions must:
a) Be accurate (where they state facts).
b) Be genuinely held (where they state opinions).
c) Comply with applicable law in the UK and in any country from which they are posted.

Contributions must not:
a) Contain any material which is defamatory of any person.
b) Contain any material which is obscene, offensive, hateful or inflammatory.
c) Promote sexually explicit material, violence, illegal activity, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
d) Infringe any copyright, database right, or trade mark of any other person.
e) Be likely to deceive any person.
f) Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
g) Be threatening, abusive, or invade another’s privacy, or cause annoyance, inconvenience, or needless anxiety.
h) Be likely to harass, upset, embarrass, alarm, or annoy any other person.
i) Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.
j) Give the impression that they emanate from us, if this is not the case.
k) Advocate, promote, or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

6. User Conduct
Users of the site undertake that they will not:
a) Use the site for any unlawful purpose, or which may harass or cause distress or inconvenience to any person, including but not limited to making available defamatory information; or
b) Use the site to transmit, distribute, or make available any information or content that contravenes any applicable law or any person’s legal rights, including but not limited to copyright, trademark, privacy, or other personal or proprietary rights.

You agree to indemnify 4C UR Future CIC against all claims, proceedings, damages, liabilities, and costs, including legal costs arising out of your breach of these Terms.

7. Interactive Services
We may provide interactive services on our site, including but not limited to, polls, surveys, competitions, quizzes, games, online directories, chat forums, bulletin boards, and messages/notifications. Data collected from interactive services may be anonymised, collated, and analysed at scale. Individual data collected may by used to personalise user experience via site customisations.

Where we do provide any interactive service that enables user-to-user communication, we will provide clear indication as to whether it is moderated and what form of moderation is used, where applicable. We endeavour to assess any possible risks for users, and in particular those under the age of 18, and we will decide in each case whether it is appropriate to use moderation of the relevant interactive service or space. However, we are under no obligation to oversee, monitor, or moderate any interactive service we provide on our site, and we expressly exclude our liability for any loss or damage arising from the use of any interactive service, whether the service is moderated or not.

The use of interactive services by a minor is subject to the consent of their parent or guardian. We advise parents/guardians who permit their children to use interactive services that it is important they communicate to their children about their safety online, as moderation is not fool-proof. Minors who are using any interactive service should be made aware of the potential risks to them. Minors under the age of 16 are not permitted to register to the site without permission of a parent/guardian.

8. Third Party Websites and Content
This site includes links to other websites and resources, and hosts functionality developed and made available by third parties. This site includes, without limitation, the following third party content:
a) Course information provided by training providers, Colleges, Universities, and UCAS, etc. who are responsible for the accuracy of the content provided.
b) Sector and job information such as salary range, career outlook, employability criteria, currently employed figures, and relevant qualification information. Sources are referenced, where possible, and information provided is dated. Information is correct at the time of publishing. Users are responsible for ensuring the information they obtain is cross-checked for accuracy.
c) Volunteering, work experience, and employment opportunities, which are provided by third party organisations, who are responsible for ensuring the information provided is accurate, up to date, and not misleading.

Where a third-party website or resource is linked to, we draw your attention to the fact that we do not control these websites, we make no representations or warranties about those websites, their content, or security, and we accept no responsibility for any loss or damage that may arise from your use of them. If you visit any third-party site, or provide your information to any third-party site, you will be required to comply with the Terms & Conditions of use of that site and the privacy of your information will be treated in accordance with the Privacy Policy/Notice of that third party.

9. Signposted Organisations
We do not undertake any assessment of schools, employers, or organisations signposted to from the site. We make no representations or provide any warranties in relation to the schools, employers, or organisations and accept no responsibility for any loss, claim, penalty, or damage that may arise from your engagement with any such person or entity in relation to learning, engagement, or opportunities.

10. Linking to the Site

11. Data and Liability
It is your responsibility to ensure that you give us an accurate and valid email address and other contact details, and to inform us of any changes to your contact details. We comply with the provisions of current Data Protection legislation, including the General Data Protection Regulation and the Data Protection Act. Our site is free to use for registered users. It is our intention that our site will be available to all. However, during the pilot phase, we will enable a phased release. We have taken all necessary measures to ensure the security and protection of your information. However, it is a condition that you use the site at your own risk. We shall not be held liable by you, or be considered in breach of these Terms & Conditions, for any delay or failure to perform any obligation, including if the delay or failure is due to a cause beyond our reasonable control, including and without limitation, the blocking or restricting of information to and/or from our network.

Despite all of our precautions, no data transmission over the internet can be guaranteed to be 100% secure. Whilst we will always strive to protect your personal information, we cannot guarantee the security of any information you disclose or transmit over the internet and wish to draw your attention that you do so at your own risk. We are not responsible for the circumvention of any privacy settings or security measures contained on the site.

The personal information we collect from you online is stored by us on databases protected through access controls, firewall technology, and other appropriate security measures. However, such security measures cannot prevent all loss, misuse, or alteration of personal information and we are not responsible for any damage or liability relating to such incidents.

The site and its contents are for general information only and are provided “as is” and on an “as available” basis. Accordingly, to the maximum extent permitted by law, we exclude all representations, warranties, conditions, and other terms. Specifically, we are not responsible for the legality, appropriateness, or otherwise of the content of any advertisements, listings, postings, or opportunities published by any employer or third party that may appear on, or be linked to by, the site. In addition, we make no warranties, representations, or undertakings about:
a) The content of the site (including, without limitation, any warranties representations, or undertakings as to the quality, accuracy, currency, completeness, or fitness for any particular purpose of such content); or
b) The content of any other third-party website or service referred to or accessed through the site.

For example, if the site links to content in any volunteering or employment opportunity that is in breach of employment or equalities laws, we will not be responsible. However, if were made aware of it, we would remove the content.

We make reasonable efforts to ensure that the site is free from viruses, malware, adware, etc. However, it is strongly recommended that you check for such viruses before downloading any content.

We accept no liability for any claims, penalties, loss, damage, or expenses arising from: any reliance placed on the content of the site; the use or inability to use the site; the downloading of any materials from the site; or any unauthorised access to or alteration to the site.

This section shall not exclude liability for any other matter that cannot be lawfully limited or excluded by law.

12. Take Down Notice Policy
In the event that you consider your rights to have been infringed by another user’s conduct, it is our intention to respond to all clear notices of copyright infringement, defamatory content, or otherwise via our Take Down Notice Policy, details of which are set out in this section.

If you believe that your own copyrighted work is accessible on the site in violation of your copyright, or that obscene or defamatory comments have been made in relation to you, then you may submit a Take Down Notice. You must include the following information within the Take Down Notice:
a) Identify, in sufficient detail, the copyrighted work or intellectual property that you claim has been infringed so that the material can be located on the site. Alternatively, provide sufficient details to locate the allegedly obscene or defamatory comment;
b) The physical or electronic signature of the person making the complaint; and
c) Sufficient contact details for the person making the complaint, including an address, telephone number and email address.

The Take Down Notice should be submitted to info@4curfuture.com with Take Down Notice as the subject.

Upon receiving a Take Down Notice, we shall remove or disable access to the allegedly infringing material if we consider it appropriate to do so. We may also advise the alleged infringer of your claim.

In the event that a Take Down Notice is received in connection with any content you have posted or made available on the site, you consent to the release of your personal contact details in connection with any investigation of fraud, intellectual property infringement, piracy, defamation or other unlawful activity. Such personal information will only be released to the complainant where required by law. In such circumstances we may, if we are required to do so, disclose your name, home address, and email address to the complainant or the complainant’s representatives.

Please note that some of the content on the site is made available by third parties. If we receive a Take Down Notice in respect of any of that content, our ability to take it down is limited and we will instead pass on your complaint to the organisations that host that information or provide it to us (as appropriate).

13. Password Protected Areas
The site may contain password protected areas, which allow you to view certain selected content. You are responsible for maintaining the confidentiality of your password and user name and are fully responsible for all activities occurring under your username or password.

When selecting your privacy settings, please consider carefully the number of people who may be able to view the information you post and whether it is safe to disclose that type of information. We recommend that you do not disclose your home address, telephone number, date of birth, or place of work, study, or school location that in any way could be publicly accessed.

14. Closing Your Account
For us to close/deactivate your account, we need you to supply us with your full name, date of birth, postcode, and the email address you registered with, to ensure we close the correct account. Please send these details to info@4curfuture.com with the subject Close My Account.

Please be aware that if you choose to close your account, there will be information and content you will no longer be able to access, including any stored information and functionality that is only available to registered users.

15. Termination and Complaints
Failure to comply with the Terms & Conditions may result in our taking any or all of the following actions:
a) Immediate, temporary or permanent, withdrawal of your right to use our site.
b) Immediate, temporary or permanent, removal of any posting or material uploaded by you to our site.
c) Issue of a warning to you.
d) Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
e) Further legal action against you.
f) Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We may terminate our agreement with you at any time. We reserve the right to seek to prevent you accessing the site or any parts of the site. You may not transfer any of your rights or delegate any of your obligations under these Terms & Conditions without our prior written consent. If we fail to enforce any provision of these Terms & Conditions, that failure will not preclude us from enforcing either that provision, or any similar provision, on a later occasion. Nothing in these Terms & Conditions shall confer on any third party any benefit or the right to enforce any term of these Terms & Conditions. These Terms & Conditions are governed by Northern Irish law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the Northern Irish courts. Nothing in these Terms & Conditions affects your statutory rights.

17. Changes to these Terms of Use
We reserve the right to amend or replace these Terms of Use at any time. If we make any substantial changes, we will notify you by posting a prominent notice on the site. You are expected to check this page from time to time to familiarise yourself of any changes we make, as they are and will be legally binding. Any changes to these Terms will be posted on this page and be clearly identified. These Terms were last updated on 14th December 2021.
